   3 Fascinating news this week about success in using
   4 [FoldIt](http://fold.it/portal/info/faq) to successfully
   5 crowdsource the
   6 [folding](http://news.yahoo.com/online-gamers-crack-aids-enzyme-puzzle-175427367.html)
   7  of an "AIDS-like virus enzyme".

   9 This is a milestone in imagining a blend of human and
  10 machine skills for, perhaps, one of the biggest health
  11 related challenges we have. The technology is awesome.
  12 The human creativity is awesome. The goal is awesome.

  14 What's striking about this story is how little is told
  15 about the fruits of this effort. My guess -- and I'm
  16 perfectly happy to be corrected -- is that the large
  17 beneficiaries of this work will be pharmaceutical companies
  18 that will patent the molecules they discover can
  19 bind to such proteins.  These molecules will be the
  20 basis for very important cures.  And the pharma with the
  21 patent will have a monopoly on that molecule for 20 years.

  23 So is there even attribution for the AIDS patient who
  24 donated her time to FoldIt? Could she benefit from the
  25 medication she helped bring to market (at a reduced price)?

  27 For many years those of us in the FLOSS community have
  28 been raising the concern that software patents do not, in fact,
  29 "promote the progress in science and the useful arts".
  30 There is growing awareness that that software doesn't pass the
  31 § 101 "machine or transformation test" and mathematics --
  32 a representation of software -- is not patent-able.

  34 The other large customers of the current patent system
  35 are big pharma.  Do pharma patents promote progress?
  36 Would the drugs come to market anyway? An *economic* analysis
  37 of this market would be enlightening.

  39 If the court of public opinion pushes Facebook
  40 to disclose privacy policy (and implement modest controls)
  41 doesn't FoldIt owe it to the community to at least disclose
  42 the "terms of service"?
