   3 The title of this blog post is a quote from Karen in the most
   4 recent Free as in Freedom oggcast

   7 : *Legal issues are an inherent part of Free and open source software generally. If you get passionate about Free and open source software you are going to find yourself immersed in legal issues. It's something I think developers are really aware of... much more so than in other fields.*

   9 I consider myself to be very passionate about FLOSS and
  10 I care about the it's legal underpinnings because
  11 I see the enormous potential good FLOSS can bring to
  12 addressing the big challenges facing the planet.
  13 Continuing to enjoy the right to engage in FLOSS
  14 depends on the legal terrain which makes it possible.

  16 We have seen the excesses of copyright maximalists in Free
  17 Culture and the damaging impact they can have.  The SOPA (PIPA)
  18 debates are simply the latest chapter in that saga.
  19 [Lessig][lessig_on_sopa] points out that, at least in the USA,
  20 we will never win that war
  21 until we win the war against corruption of our Republic.
  22 We must strike the root of the problem in addition to the branches.
  23 I say we must remain vigilant about the branches as well.

  25 FLOSS is another branch which is as important as Free Culture.
  26 Understanding that FLOSS
  27 is possible due a *hack* on copyright underscores how critical
  28 it is for developers to be aware of the legal environment in
  29 which their creativity can thrive.
  30 And the escalating software patent war -- especially in Java and mobile --
  31 has had a chilling effect on innovation.

  33 One the strengths (can we think in terms of *countermeasures*?)
  34 of our community is that we function
  35 out of basic principles of transparency and respect.
  36 The traditions in FLOSS like the traditions in the early
  37 open Internet form a culture of true innovation
  38 where working code drives collaboration and makes it
  39 possible to "stand on the shoulders of giants".
  40 [Fontana][fontana] has talked about this [*lex mercatoria*][lexmerc] in Free
  41 Software as an essential part of understanding the
  42 context of legal issues in FLOSS. I hope he will expand
  43 on this in his new blog.

  45 I am optimistic that if we combine our brainpower to protect
  46 FLOSS as we do to create awesome software we can enable
  47 new kinds of working together which other fields
  48 will emulate. I can't wait to explore the frontier of
  49 the future possible.
